Terms of Service

1. Who we are

benchnext ("benchnext," "we," "us") is a software-as-a-service product operated by Evrim Olçum, a sole-proprietor software maker. Our contact address is evrim.olcum@kodado.co.

These Terms of Service ("Terms") govern your access to and use of the benchnext website, web app, and related services (the "Service"). By creating an account, paying for a founding membership, or otherwise using the Service, you agree to these Terms. If you do not agree, do not use the Service.

2. What benchnext is

benchnext is an order-tracking tool for solo craft makers — for example bladesmiths, leather workers, luthiers, and woodworkers — who take custom commissions. The Service helps makers record commissions, share a structured intake form with their customers, and send template-based status replies. benchnext does not process customer-to-maker payments and does not act as a marketplace.

3. Eligibility and accounts

You must be at least 18 years old and able to enter into a binding contract to use the Service. You are responsible for keeping your account credentials confidential and for all activity that occurs under your account.

4. Subscriptions, founding memberships, and billing

We offer two paid options:

• Founding membership. A one-time payment of US$20 purchased before public launch. Founding members receive twelve (12) months of access included at no additional cost once the Service launches, followed by a discounted recurring subscription of US$9 per month for as long as the subscription remains active and uncancelled.
• Standard subscription. A recurring monthly subscription priced at US$19 per month, available after public launch. Subscriptions renew automatically each billing cycle until cancelled.

Payments are processed by our third-party payment provider, which acts as the merchant of record. Applicable taxes may be added at checkout. Prices are in US dollars unless otherwise stated. We may change pricing for future billing periods with reasonable notice; existing founding-member rates will be honored as described above.

5. Refunds

Refunds are governed by our Refund Policy, which forms part of these Terms. In short: founding-member fees are fully refundable any time before public launch, and standard subscriptions can be cancelled at any time; the current billing cycle remains active until its end.

6. Acceptable use

You agree not to:

• Use the Service to violate any law, infringe any third-party right, or transmit unlawful, harassing, or harmful content.
• Attempt to reverse-engineer, scrape, or interfere with the operation or security of the Service.
• Resell, sublicense, or operate the Service on behalf of another business without our written permission.
• Use the Service to send unsolicited marketing or spam to your customers.

7. Your content

You retain ownership of the data you upload — commission records, customer details, photos, and templates ("Your Content"). You grant us a limited license to host, store, and process Your Content solely to operate and improve the Service for you. You can export Your Content as a single archive at any time and we will delete it within thirty (30) days of account cancellation, except where retention is required by law.

8. Customer data you collect

When you use benchnext to collect specs and contact information from your customers, you act as the data controller for that information. You are responsible for having a lawful basis to collect it and for complying with privacy laws applicable to you and your customers (including GDPR, UK GDPR, and CCPA where relevant). benchnext acts as a data processor on your behalf.

9. Service availability and changes

benchnext is in active development. Features may be added, changed, or removed. We aim for high availability but do not guarantee uninterrupted service. Scheduled maintenance and unforeseen outages may occur.

10. Disclaimers

The Service is provided "as is" and "as available," without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement, to the maximum extent permitted by law.

11. Limitation of liability

To the maximum extent permitted by law, benchnext and its operator will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, arising from your use of the Service. Our total aggregate liability for any claim arising out of or relating to the Service will not exceed the greater of (a) the amount you paid us in the twelve (12) months preceding the claim or (b) US$50.

12. Termination

You may cancel your account at any time. We may suspend or terminate your access if you breach these Terms, fail to pay, or use the Service in a way that risks harm to us or other users. On termination, your right to use the Service ends immediately; sections that by their nature should survive termination will continue to apply.

13. Changes to these Terms

We may update these Terms from time to time. If we make material changes we will notify you by email or through the Service before the changes take effect. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.

14. Governing law and disputes

These Terms are governed by the laws of Türkiye, without regard to its conflict-of-laws principles. Any dispute will be resolved in the competent courts of Istanbul, Türkiye, unless mandatory consumer protection laws of your country of residence provide otherwise.
